　　乙方：

　　甲乙双方经平等协商，就甲方委托乙方打井施工事宜达成共识，并签订如下合同条款：
　　一、工程地点
　　在甲方指定地点。
　　二、工程项目及相关要求
　　1、施工项目：水井壹眼。
　　2、尺寸要求：井管直径：38CM；护壁5CM；井深102米。
　　3、材料选用：护壁为混凝土。
　　4、技术要求：保证枯水期正常用水，出水量为40立方米/天以上。
　　5、施工中若遇见大石块、淤泥等特殊地质情况由乙方自行解决。
　　6、按相关标准，确保工程质量、安全、进度。
　　三、承包形式
　　包工包料，包开挖水井所用的机械设备，包安全防护。
　　四、工期要求
　　施工工期为签订合同之日起日历天数20天。
　　五、工程价款
　　工程总价款为人民币35000元，大写：叁万伍仟元人民币整。
　　以上总价款为甲方应付给乙方的全部费用，含工程混凝土护壁主材料费、辅助材料费、人工费、运杂费等全部费用。此外，甲方不再向乙方支付任何费用。
　　六、付款方式
　　1、乙方工程完工，并经甲方验收合格，甲方将首付工程款95%给乙方。
　　2、完成验收交付后甲方试用两个月，若再无问题，再付清剩余5%工程款。
　　3、工程结算款以人民币现金的方式支付。
　　七、其它约定
　　1、若打水失败（未出水或中途停工）或达不到甲方要求，甲方不承担任何费用。
　　2、甲方为乙方施工提供方便，打井用电由甲方提供。
　　八、安全责任
　　1、施工过程中，乙方应加强施工安全管理工作，施工中若造成人员伤亡、财产损失等事故由乙方自负全责。
　　2、乙方在施工期间要做好井周围警示防护措施，杜绝闲杂人等靠近，若因此而造成安全事故也由乙方自负。
　　九、合同生效与终止
　　本合同一式二份，甲乙双方各执一份。双方签字盖章后即日生效，结清合同价款后，合同效力自行终止。
