　　甲乙双方当事人在平等协商、自愿、有偿的原则下，根据《合同法》、《农村土地承包法》、《农村土地承包经营权证管理办法》和《农村土地承包经营权租赁管理办法》的有关规定，特订立本合同，双方共同遵守。

　　三、甲方的权利、义务
　　（一）甲方应享有下列权利

　　1、维护乙方的土地经营自主权和农产品处置权，不得干涉乙方依法进行的农业生产经营活动。

　　四、乙方的权利、义务
　　1、依照合同约定，按时足额向甲方交纳土地租赁费，维护甲方的承包权利。
　　2、维护甲方耕地内外附着物的完整，不得随意滥砍乱伐。若遇重大公益性事业，除应承担合同规定的租赁费外，还应承担新增加的生产性公益费用。
　　3、法律、行政法规规定的其他义务。
　　五、租赁土地价款及支付方式
　　经双方协商，由乙方付给甲方年租赁费　　元，并于每年　月　日前将本年度租赁费以现金一次性向甲方付清。
　　六、违约责任
　　（一）合同履行期间，因不可抗力而不能履行合同时，租赁费用由双方协商解决。
　　（二）合同履行期间，若一方违约给对方造成损失的，除应赔偿造成的损失外，还应向对方支付租赁费总额20%的违约金。
　　（三）合同履行期间，甲方地上的附着物乙方不得擅自处置。擅自处置造成损失的，乙方应承担赔偿责任。
　　（四）法律、法规规定的其他违约责任。
　　七、其他事项
　　（一）合同履行期间若遇国家征占土地，本合同应自行终止。
　　（二）本合同条款未尽事宜，经双方共同协商后可补签附加协议，附加协议与本合同具有同等法律效力。
　　（三）本合同一式四份（需鉴证时一式五份），甲、乙双方各一份，签证方备案一份（鉴证机关一份），自双方签字后生效。
