　　由于受社会舆论等多重因素的影响，城管在执法过程中，经常遇到相对人使用“讹人”、“耍无赖”等手段逃避处罚或诬陷执法队员的现象，针对此现象，我们建议应从以下几方面进行规避：
　　一是摸清情况，掌握重点。这类现象往往出现在多次处罚过的相对人身上。在日常执法时，队员要善于发现和掌握相对人的情况，对屡教不改的重点相对人要做好执法前的准备和执法中的管控工作。
　　二是建立周密的整治方案，杜绝仓促执法。在重点地区治理执法时，要做好前期的预案，做好充足准备工作，杜绝盲目执法或仓促执法。
　　三是做好取证，保存执法痕迹。执法时，我们要充分发挥取证设备的作用，它是证明执法队员文明执法、有效打击相对人违法行为的有力武器。
　　四是积极应对，有效遏制。面对执法风纪的投诉，一方面，我们要积极应对，检查我们执法中存在的问题和纰漏，掌握实情或加以整改；另一方面要积极与投诉人沟通，听取诉求。如果是我们执法中存在问题，要合理化解；对恶意诬陷的行为，用取证事实说明情况并对相对人从严从重处罚，有效遏制相对人的诬陷行为。
